1. We will be pleased to start the project promptly after we receive your acceptance of our quotation, the requested information, and applicable professional fees.
2. 50% Payment advance for the start project, and the remaining payment on the day of delivery.
3. The client has to give content, images & other necessary data for website design & development.
4. Premium theme & plugin charges will be payable by the client.
5. Domain/Hosting registration charges are not included as a part of the quotation unless mentioned otherwise.
6. Client website design/development estimates are given based on client requirements, hosting provider company features, and configuration.
7. The given quotation is valid for only 7 days.
8. The given quotation price is not negotiable at any time.
9. The given quotation price is the final price of your project. after there if you add any extra features or services to this project, we’ll take extra charges.
10. During the project briefing, it is the client’s responsibility to provide us with clear guidelines along with the flow or specific details you may require. When such details are not provided, we will proceed with our understanding of your requirements and quote accordingly. At a later stage, if a discrepancy arises, it may lead to additional costs to accommodate the changes. Thus, it is essential that you clarify every aspect of your website development and ensure that you have been quoted on the right requirements.
11. Once the proposal has been finalized, any additions, changes, or enhancements in the functionality or design of the project will affect the proposal and may incur additional costs and a revised delivery date. All additional work, over and above the estimates is charged separately. Under no circumstances will Capital Web be liable for any delays caused by a change in the project brief.
12. Capital Web offers packages in coordination with third-party providers. Changes to the third-party provider’s rules and policies may ultimately affect the services we provide or the terms and conditions herein.
13. After the project is completed, first 3 months we’ll provide free maintenance & technical support.
14. During the maintenance period, we just maintain the backend/frontend and fix technical errors/faults. We can not provide add/update extra service during this maintenance period for this you have to pay extra.
15. After the website handling & maintenance period is over then we’ll take extra charge by month/year wise to maintain your service/project.
16. If the client(you) delay some pending work or project then you have to pay the remaining payment.
17. The client hereby admits that capital web is not accountable for grammatical errors. otherwise found in the material provided by a client.
18. The client admits that Capital Web will add a “Web Design” by “Capital Web” link to the footnote section of each website they work on. This is the branding of Capital Web and to eliminate it will charge.
19. Due to its business nature, Capital Web will not be liable if your website got hacked, lost rankings or errors, etc.
20. Also, web hosting and paid theme/plugin or extra paid service money are non-refundable.
21. The discussion of the requirement during the customer meeting will be considered final. Apart from this, after the project starts, the customer will have to pay extra for extra requirements or services.
22. For e-commerce websites, for the first time, we’ll add 20-30 products. After that additional charge will be taken for adding/Updating the product.
23. For e-commerce websites, we’ll provide a free admin panel demo to manage their order, sales, and products.
24. We shall extra charge for extra customization any major changes Add/Update web pages or anything to the website.
25. Yearly domain/SSL/hosting renewal charges extra every year based on your plan/package.
26. The project delivery time depends on the client project type and until full fill project requirements. This may take some time if the customer does not submit the material and required data on time or if a technical issue occurs.
27. Any premium service/server/configuration up-gradation charges extra based on their latest price. (if where required).
28. For image editing, cut/crop & background removal charges will be extra added to the client estimate.
29. Advance payment is non-refundable if the project work has been started by the developers.
30. We’ll not provide project source code/server access/control panel access or any private system access to the client.
31. If the customer has bought web hosting on his own and it will be of low configuration and it creates any problem in the future, then we will not be responsible for that.
32. If clients have access to admin panel/C-panel/database or source code and they do any type of changes from their side in source code, database, or any file and after then they face any error then we are not responsible for that.
33. When clients decide to organize their own hosting, we should be consulted before finalizing the type of hosting and database, as it should meet the requirements of the technology used for the development. Please note that we’ll require full access to hosting support for testing and deploying the application. Capital Web will not be liable for any delays or errors caused by direct or indirect actions of the hosting company.
34. You cannot do a different type of deal with us by comparing other companies’ services and prices or falling under the guise of any other company or other web developers. It will not be valid.
35. If you have done your project deal with us without reading or agreeing to our terms & conditions after then any issue occurs, then we are not responsible for any reasons. this is your responsibility to deal with every company after reading or agreeing with their terms & conditions.
36. You can not remove our footer credit from your website (Ex. Developed by Capital Web), if you remove the footer credit then all our support systems and technical support are closed for your website which means we can not provide any kind of support or help for your website.
37. We have all rights to terminate your service or update these terms & conditions at any time without informing you.

1. The client has to pay 50% in Advance for logos, Brochures, Flyers, Menu cards, Product Catalog design, Leaflet design, and Magazine Design.
2. The client has to pay 100% in Advance for the Invitation/greeting card, Stationary Design packages, Banner, Sticker, Tag, Letterhead, Business/Visiting Card, Packaging/Label, Envelope, Social Media Post, Festival post, and other single posts designs.
3. We’ll provide original editable files only for print media design.
4. The design price will be up-down based on client requirements.
5. The design price is not negotiable at any time.
6. Advance payment is not refundable if work has been started.
7. If an issue occurs in printing, then we are not responsible for that.
8. Maximum revision up to 3 times only for all types of design.
9. The client will have to give suggestions, references, or ideas to complete their work in any way they like.
10. You cannot do a different type of deal with us by comparing other companies’ services and prices or by falling under the guise of any other company or other graphic designer. It will not be valid.
11. If you have done your project deal with us without reading or agreeing to our terms & conditions after then any issue occurs, then we are not responsible for any reasons. this is your responsibility to deal with every business after reading or agreeing with their terms & conditions.
12. We have all right to update these terms & conditions at any time without informing customers.

1. The client has to pay 100% in advance for the Festival Post Design.
2. Given festival list is the final list, for extra festival posts customers have to pay an extra charge per post ₹250.
3. Before designing the festival post frame, it is the responsibility of the customer to provide the correct contact data.
4. We give only a single festival post-design option for each festival.
5. We’ll provide festival posts only in English language only (Hindi available sometimes).
6. A customer has to choose the festival post frame from the given festival post frame design options. And your selected frame is considered the final frame and it’ll not change.
7. We will give a whole week or month of festival posts at once on your WhatsApp.
8. We’ll not send posts to more than 1 number, so pls confirm the first on which WhatsApp number you want to receive all posts.
9. Payment is non-refundable in any condition.
10. Customers can not change or add designs by removing some festivals from the given festival list.
11. For our Regular festival post package, we can not provide any custom requirement design or option.
12. We have the right to change these terms without informing the customer.

3. Client Obligations

You agree to provide accurate, current, and complete information as required for the provision of Services. Failure to provide accurate information may result in the termination of Services.

3.2 Access and Cooperation

You agree to provide us with necessary access to your social media accounts and any other resources required to perform the Services. You will cooperate with us by providing timely feedback, approvals, and any other information that may be necessary for the completion of the Services.

3.3 Compliance with Laws

You agree to comply with all applicable laws, rules, and regulations while using our Services. You are responsible for any content you provide to us or post on your social media accounts.

4. Payment Terms

4.1 Fees

The fees for our Services will be outlined in a separate agreement or invoice. All payments are due within 5 Days from the date of the invoice unless otherwise agreed upon in writing.

4.2 Late Payments

If you fail to make a payment on time, we reserve the right to suspend or terminate our Services until payment is made. Late payments may be subject to interest charges as specified in the invoice or agreement.

4.3 Refunds

All payments made for our Services are non-refundable unless otherwise stated in writing.

5. Intellectual Property

5.1 Ownership

All content, designs, strategies, and materials created by us in the course of providing the Services are the intellectual property of Capital Web. Upon full payment of all fees, you are granted a non-exclusive, non-transferable license to use the deliverables for the intended purpose.

5.2 Client Content

You retain ownership of any content you provide to us. You grant us a limited license to use your content to provide the Services.

6. Confidentiality

6.1 Confidential Information

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of the Services. This obligation will continue even after the termination of the agreement.

6.2 Exceptions

Confidentiality obligations do not apply to publicly available information, independently developed, or required to be disclosed by law.

7. Limitation of Liability

7.1 No Warranty

Our Services are provided “as is” without any warranties, express or implied. We do not guarantee any specific results from the use of our Services.

7.2 Limitation of Damages

In no event shall Capital Web be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of our Services.

7.3 Maximum Liability

Our maximum liability for any claim related to the Services shall not exceed the amount you paid for the Services.

10. Performance and Guarantees

• Capital Web will implement best practices and strategies to enhance the client’s social media presence organically.
• The performance of social media campaigns and strategies is dependent on various factors, including but not limited to the industry, target audience, platform algorithms, and the client’s own content quality and engagement.

10.2 No Guarantees of Specific Results

• Capital Web does not guarantee specific metrics or outcomes, such as a precise number of new followers, engagement rates, or sales conversions.
• Organic social media growth can be unpredictable and influenced by factors outside Capital Web’s control, including changes in social media platform algorithms and market trends.

10.3 Measurement and Reporting

• Capital Web will provide regular performance reports that detail key metrics, including growth in followers, engagement rates, and content performance.
• Reports will be based on the data available from social media platforms and will offer insights into the effectiveness of the strategies employed.

10.4 Adjustment and Optimization

• Capital Web will continuously monitor and adjust strategies based on performance data to improve results.
• The client agrees to collaborate on strategy adjustments and to provide timely feedback to optimize performance.

10.5 Limitation of Liability

• While Capital Web will use its expertise and best efforts to achieve desired outcomes, the client acknowledges that results are not guaranteed. 
• Capital Web is not liable for any losses or damages arising from the performance or non-performance of the social media marketing services.

10.6 Dispute Resolution

• Any disputes regarding performance or results will be handled according to the terms outlined in the “Governing Law” and “Dispute Resolution” sections of this agreement.

• Content: You are responsible for providing accurate, complete, and timely content, images, and other materials required for the execution of our services.
• Communication: You agree to respond to our queries and requests in a timely manner to ensure the effective implementation of our services.

4. Payment Terms

• Fees: Fees for services are outlined in the proposal or invoice provided to you. Payments are due as specified in the invoice.
• Late Payments: Late payments may result in the suspension of services until the outstanding balance is paid in full. Late fees may also apply.
• Refunds: Due to the nature of SEO work, we do not offer refunds once work has commenced.

5. Performance and Guarantees

• No Guarantees: SEO is a complex process, and while we strive to achieve the best possible results, we do not guarantee specific rankings, traffic, or sales increases.
• Timeframes: SEO results can take time to materialize. You acknowledge that results may vary depending on various factors, including industry competitiveness, existing website status, and market conditions.

6. Limitation of Liability

• Indirect Damages: Capital Web shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services.
• Total Liability: Our total liability shall be limited to the amount paid by you for the services rendered.

7. Confidentiality

Both parties agree to keep confidential all proprietary and sensitive information exchanged during the course of our relationship. This obligation shall continue even after the termination of services.

8. Intellectual Property

All intellectual property, including but not limited to, SEO strategies, content, and designs created by Capital Web, shall remain the property of Capital Web unless otherwise agreed upon in writing.

9. Termination

• Termination by Client: You may terminate our services at any time by providing 30 days’ written notice. However, payments for services already rendered are non-refundable.
• Termination by Capital Web: We reserve the right to terminate services if you breach any of these Terms or fail to make timely payments.

10. Amendments

We reserve the right to amend these Terms at any time. Any changes will be effective immediately upon posting on our website or notification to you.

11. Entire Agreement

These Terms constitute the entire agreement between you and Capital Web concerning the provision of SEO services and supersede any prior agreements or understandings, whether written or oral.
